35. KITAB AS SALAM – Sales in which a Price is paid for Goods to be Delivered Later.

1. BAAB: Muqarrar Paimane ME Ba’e silm KARNA (As-Salam by a definite known specified measure)

۞ Hazrat Ibn Abbas r.a. se riwayat hai, inhone farmaya ke Rasool ﷺ jab Madeena tashreef laye to (Madeena ke) log falon me saal ya do saal ke liye Ba’e silm karte the. (Inhone farmaya ke do saal ya teen saal ke liye Ba’e silm karte the. Ismayeel (Ibn Aliyah) (raawi e hadith) ko shak hua tha). Rasool ﷺ ne farmaya:”Jo koi bhi khazooron ke liye peshgi adai karta hai to ise chahiye ke muqarrar paimaane aur muqarrar wazan ke wazahat ke saath Ba’e silm kare.”

2. BAAB: TAUL YA WAZAN MUQARAR KAR KE BA’E SILM KARNA

۞ Hazrat Ibn Abbas r.a. se riwayat hai, Inhone farmaya ke Rasool ﷺ jab Madeena tayyabah tashreef laye to wahan ke bashinde do teen saal ki miyaad par khazooron  ke mutalliq peshgi raqam ada karte the. Aap ﷺ ne farmaya: “Jab koi kisi cheez ke mutalliq Ba’e silm kare toh Muqarrar Paimane, muqarrar wazan, aur muqarrar meyaad thehra kar kare.”

۞ Hazrat Ibn Abbas r.a. se riwayat hai inhone farmaya ke jab Nabi ﷺ Madeena Tayyabah tashreef laye, Fir mazkurah bala hadees yun bayan farmayi : “Muqarrar Paimane, Muqarrar Wazan aur Muqarrar Muddat thahra kar Ba’e silm ki jaye.”

۞ Hazrat Abdullah bin Abu Mujalid se riwayat hai, inhone kaha ke Abdullah bin Shaddad  aur Abu Burda r.a. ne Ba’e silm ke mutalliq iqhtilaaf kiya toh logon ne mujhe Hazrat Ibn Abi Aufa r.a. ke paas bheja. Maine in se is ke mutalliq daryaaft kiya to inhone farmaya : Hum Rasool ﷺ , Hazrat Abu Bakar aur Hazrat Umar r.a. ke zamane me gandum, ja’u, munaqqa aur khazoor me Ba’e silm karte the. Fir mein ne Ibn Abza se is ke mutalliq pucha to inhone bhi yahi jawab diya.

3. BAAB: AISE SHAKSH SE BA’E SILM KARNA JIS K PASS ASAL MAAL HI NAHI HAI

۞ Mohammad Bin Abu Mujalid se riwayat hai, inhone kaha mujhe Abdullah bin Shadad aur Abu Bardah r.a. ne Hazrat Abdullah Bin Abi Aufa r.a. ke paas yeh daryaft karne ke liye bheja ke Kya Nabi ﷺ ke zamane me gandum mein Ba’e silm kiya krte the ? Hazrat Abdullah Bin Abi Ufi r.a. ne farmaya : Haan! Hum Shaam ke kashtikaron (peasants) se gandum, jaw  aur zaytun ka tel ek muqarrar paimane aur muqarrar muddat taye kar ke Ba’e silm kiya karte the. Maine daryaaft kiya : Kya sirf usi shaks se  ap log yeh sauda kiya karte the jis ke paas asal maal hoti thi ? Inhone jawab diya : Hum in se yeh nahi poochte the. Fir Inhone mujhe Abdul Rahman Bin Abza ke pass bheja. Mein ne in se daryaft kiya to inhone bhi yahi jawab diya ke Nabi ﷺ ke ahad mubarak mein Nabi ﷺ ke sahaba-e-karam Ba’e silm kiya karte the. Aur hum in se yeh nahi poochte the ke in ke paas kheti hai ya nahi.

۞ Mohammad Bin Abi Mujalid se riwayat ke yeh alfaaz hai : Hum gandum aur ja’w mein Ba’e silm kiya karte the. Aur Sufiyan se riwayat hai ke Shayabani ne is me lafz “Roghan” ka izafa kiya hai. Aur Jareer ne Shayabani se jo hadees bayan ki hai us me “Gandum, Ja’w aur Munaqqa” ke alfaaz hai, yaani in ashyaai mein Ba’e silm karte the.

۞ Abu Bakhtari Tai se riwayat hai, inhone ne kaha ke maine Ibn Abbas se pooocha ke jo khazooren darkht par lagi hui ho in ke mutalliq Ba’e silm karna kaisa hai ? Inhone jawab diya ke Nabi ﷺ ne darkht par lagi khazoor ki Ba’e se manaa farmaya hai jab tak wo khaane ke kabil aur wazan ke layek na ho jaye. Ek shaksh ne poocha : Kis cheez ka wazan kiya jaye? To ek shaksh, jo in ke pass bitha tha, bola, yaani andaaza karne ke layek ho jaye.
Abu Bakhtari ne Hazrat Ibn Abbas r.a. se ek riwayat ki hai ke Nabi ﷺ ne is jaisi Ba’e se manaa farmaya hai.

4. BAAB: DARKHT PAR LAGI KHAZOORON KI BA’E SILM

۞ Abu Bakhtari se riwayat hai, inhone kaha ke Mai ne Hazrat Ibn Umar r.a. se (darkht par lagi hui) khazoor ke mutallik pucha. Unhone farmaya ki RasoolALlah ﷺ ne (darakht par lage hue khajur) ki khareed aur farokht se mana kiya tha hatta ke in me salahiyat paida ho jaye. Aur udhaar chandi ko udhaar, naqad ke badle bechne se bhi manaa farmaya tha. Mai ne Hazrat Ibn Abbas r.a. se darkht par lagi hui khazoor me silm se mutalliq poocha to inhone farmaya : Nabi ﷺ ne darkht par lagi khazoor ki khareed aur farokht se manaa farmaya taake wo khaane ke kabil ho jaye aur wazan ke layek ho jaye.

۞ Hazrat Abu Bakhtari se riwayat hai, Inhone kaha ke maine Hazrat Abdullah Bin Umar r.a. se khazoor me Ba’e silm ke mutalliq daryaft kiya to inhone kaha ke Nabi ﷺ ne falo (fruits) ke Ba’e se manaa kiya hai jab tak in me salahiyat paida na ho jaye. Aur Aap ﷺ ne sone ke awaz chandi ki Ba’e se bhi manaa kiya jab ke ek udhaar aur doosra naqad ho. Fir main ne is ke mutalliq Hazrat Ibn Abbas r.a. se poocha to inhone kaha ke Nabi ﷺ ne khazoor ki Ba’e se mana kiya hatta ke wo khane ke qabil ho jaye aur in ka wazan kiya ja sake. Maine arz kiya : Wazan kiye jaane ka kya matlab hai ? Toh ek shaks ne jo un ke pass baithe hue the, kaha ke matlab ye hai ke jab tak wo is qabil na ho jaye ke wo andaza kiye ja sake.

5. BAAB: BA’E SILM MEIN KISI KO ZIMMEDAR BANANA

۞ Hazrat Ayesha r.a. se riwayat hai, inhone farmaya ke Rasool ﷺ ne ek Yahudi se udhar par galla khareeda aur is ke paas apni lohe ki zirah girwi rakh di. Sahih al-Bukhari, Vol. 2, Book 35, Hadith 2251.

6. BAAB: BA’E SILM MEIN GIRWI RAKHNA

۞ Hazrat Amash se riwayat hai, inhone kaha ke humne Ibrahim Nakhi ke saamne Ba’e silm mein girwi rakhne ka zikr kiya to inhone kaha : Mujhe Aswad ne Hazrat Ayesha r.a. se hadees bayan ki hai ki Nabi ﷺ ne ek Yahoodi se muqarrar muddat tak adaigi par kuch galla kharida aur is ke paas lohe ki zirah girwi rakh di.

7. BAAB: MUQARRAH MUDDAT TAK K LYE BA’E SILM KARNA

Hazrat Ibn Abbas, Hazrat Abu Sayeed Khudri r.a. Hazrat Hasan Basri aur Hazrat Aswad r.a. is ke qail hai. Hazrat Ibn Umar.a. ne farmaya: Agar galle ka narkh aur is ki sifat maloom ho to is ki miyaad muqarrar kar ke salam karne me koi harj nahi bashart e ke wo galla kisi khaas khet ka na ho jis ki salahiyat abhi zahir na hui ho.

۞ Hazrat Ibn Abbasr.a. se riwayat hai, Inhone farmaya ke Nabi ﷺ Madina Tayyaba tashreef laye to log falon ke mutalliq Do(2) saal se Teen (3) saal udhaar par sauda kiya karte the. Aap ﷺ ne farmaya : “Agar tumne Falon me udhaar karna ho toh paimana bhi maloom ho, muddat bhi moayyan ho.”
Ek dusri riwayat me hai ke Aap ne farmaya: “Falon ka paimana ya wazan maloom ho.”

۞ Hazrat Mohammad Bin Abu Mujalid se riwayat hai, Inhone ne kaha ke mujhe Abu Burda aur Abdullah Bin Shaddad r.a. ne Hazrat Abdul Rahman Bin Abza aur Hazrat Abdullah Bin Abi Aufa r.a. ke pass bheja chunanche main ne in se Ba’e silm ke mutalliq daryaft kiya toh inhone farmaya: Hume RasoolAllah ﷺ ke humraah ganimat ka maal milta tha aur humare pass Mulk shaam ke kashtikaron (peasants) mai se kuch log aate to hum in se gandum, Jau aur munaqqa ke mutalliq muayyan muddat ki adaigi tak Ba’e silm karte the. Maine kaha : In ki kheti hoti thi ya nahi ? Inhone kaha: Is ke mutalliq hum in se daryaaft nahi kiya karte the.

8. BAAB: OOTNI KE BACCHA JANNE K MUDDAT TAK KE LYE BA’E SILM KARNA

۞ Hazrat Abdullah Bin Umar r.a. se riwayat hai, inhone farmaya ke daure jahilyat me log Habal-al-Habala ke muddat tak ke liye par oonto ko bechte the to Nabi ﷺ ne is se manaa farma diya.
Hazrat Nafi ne Habal-al-Habala ki tafseer bayan alfaaz ki ke oontni baccha jane jo iske pet me hai.
