37. KITAAB-UL-IJARA’AT

(1) BAAB : NEK SHAKHS KO MAZDOORI PAR RAKHNE AUR ALLAH TA’ALA KE FARMAAN : “BESHAK SAB SE ACHCHA MAZDOOR JO TU RAKHE WO HAI JO TAQATWAR, AMAANAT DAAR HO” KA BAYAAN, NEZ AMANAT DAAR KHAZANCHI KA AUR IS SHAKHS KA BAYAAN JO OHDE KE KHWAHISH MAND KO OHDA NA DE.

۞ Hazrat Abu Musa Ash’ari r.a. se riwayat hai, unhone kaha ke Nabi ﷺ ne farmaya : “Amaanat daar khazanchi jo hukm ke mutabik dili khushi se theek theek adayegi karta hai wo Sadqa karne walon mein se ek hai.”

۞ Hazrat Abu Musa Ash’ari r.a. hi se riwayat hai, unhone kaha : Mai Nabi ﷺ ki khidmat mein hazir hua jab ke Ash’ari Qabile ke do (2) aadmi mere saath the. Maine arz kiya : Mujhe yeh ilm nahi tha ke yeh dono ohde ke talab gaar hain. Aap ﷺ ne farmaya : “Jo hamare kisi ohde ka talab gaar hota hai hum use wo ohda hargiz nahi dete.”

(2) BAAB : CHAND KIRAAT PAR BAKRIYAN CHARANA

۞ Hazrat Abu Hurairah r.a. se riwayat hai, wo Nabi ﷺ se bayaan karte hain, Aap ne farmaya : “Allah Ta’ala ne koi Nabi aisa nahi bheja jis ne bakriyan na charayi hon.” Sahaba-e-kiraam ne arz kiya : Aap ne bhi ? Aap ne farmaya : “Haan ! Mai bhi chand kiraat ke ewaz Ahl-e-Makkah ki bakriyan charaya karta tha.”

(3) BAAB : MUSHRIKEEN KO BA-WAQT ZAROORAT YA US WAQT, JAB KOI MUSALMAAN MAZDOOR NA MILE, MAZDOORI KE LIYE RAKHNA

Nabi ﷺ ne Yahood-e-khaibar ko kheti baari ke liye rakha

۞ Hazrat Ayesha r.a. se riwayat hai ke Nabi ﷺ aur Hazrat Abu Bakr r.a. ne Hijrat ka raasta batlaane ke liye ek maahir shakhs ko rakha jo Banu dail se tha. Yeh Banu Bin Adi ka ek khandaan hai… Khirayat raasta batane mein maahir shakhs ko kahte hain… Shakhs Aas Bin Wa’el ke khandaan se muahide mein bada mazboot shareek raha tha aur Kuffar-e-Quraish ke deen par tha. Dono hazraat ne is par aitmaad kiya aur apni dono sawariyan iske hawale kar diye aur us se teen (3) din ke baad Ghaar-e-Soor mein aane ka wada liya, chunanche wo teesri raat ki subah ko dono sawariyan le kar un ke paas aaya to aap dono rawana huye. Unke saath Aamir Bin Fuhaira bhi chale aur wo rehnuma bhi jo qabila Dail se tha. Wo inhe Makkah ke zereen elake, yaani saahil-e-samundar ke raaste par le gaya.

(4) BAAB : KOI SHAKHS KISI KO IS SHART PAR MAZDOOR RAKHE KE TEEN (3) DIN, YA EK (1) MAAH YA EK (1) SAAL KE BAAD ISKA KAAM KARE TO JAYEZ HAI. JAB TAY SHUDA WAQT AAYEGA TO DONO APNI SHART PAR QAAYAM RAHENGE

۞ Nabi ﷺ ki zaujaah Mohtarma (umm-ul-momineen) Hazrat Ayesha r.a. se riwayat hai ke Rasool Allah ﷺ aur Abu Bakr r.a. ne Banu dail ke ek shakhs ko, jo raasta batane me maahir tha, ba-taur guide (rehnuma) muqarrar kiya, halanke wo Kuffar-e-Quraish ke deen par tha. Un dono ne apni ootniya uske hawale kar diye aur us se yeh wada liya ke wo teen (3) raaton ke baad (teesri raat ki subah ko ootniya le kar) Ghaar-e-Soor par aaye, chunanche wo (hasab-e-wada) teesri raat ki subah dono sawariyaan le kar wahan aa gaya.

(5) BAAB : JIHAAD MEIN MAZDOOR SAATH LE JAANA

۞ Hazrat Ya’ali Bin Umaiyya r.a. se riwayat hai, unhone kaha ke maine Nabi ﷺ ke humraah Jaish-e-Usraah (Gazwah-e-Tabook) mein shirkat ki. Mere nazdeek sabse zyada jin aamaal par mujhe aitemaad hai unme se ek yeh hai. (Kahte hain ke) mere saath mera ek mazdoor bhi tha. Wo ek shakhs se lad pada to unme se ek ne dusre ki ungli kaat khai. Usne apni ungli kheenchi to saamne wala us ka saanya daant bhi gira diya. Wo Nabi ﷺ ke paas muqadma le kar gaya to Aap ne ise lagoo qaraar diya aur farmaya : “Kya wo apni ungli tere muh mein chhor deta ke tu use chaba jaata ?” Hazrat Ya’ali r.a. ne kaha : Mere gumaan ke mutabiq Aap ne farmaya : “Jaise oont chaba jaata hai.”

۞ Abdullah Bin Abi Malayikah se riwayat hai, wo apne dada se isi ka ek qissa bayan karte hain ke ek shakhs ne dusre ka haath kaata to us ne iska saanya daant kheech liya. Hazrat Abu Bakr r.a. ne daant ki deet baatil kardi.

(6) BAAB : JISNE KISI MAZDOOR KO UJRAT PAR LAGAYA, MUDDAT AMAL TO TAY KAR DI LEKIN KAAM KI WAZAHAT NA KI

Irshad-e-Baari Ta’ala hai : “Mai chahta hun ke apni un do (2) betiyon mein se ek ka nikah tujh se kardu… aur hum jo qaul-o-qaraar kar rahe hain is par Allah nigahbaan hai.”

Imaam Bukhari farmate hain ke (یا جر فلانا) ke maani hain : “wo us ko mazdoori deta hai.” Taziyat karte huye kaha jaata : ( اجرک اللہ ) “Allah Ta’ala tujhe ajar de”.

(7) BAAB : KISI MAZDOOR KO IS KAAM KE LIYE RAKHNA KE WOH GIRTI HUYI DEEWAAR KO SEEDHA KAR DE TO AISA KARNA JAYEZ HAI

۞ Hazrat Ibn-e-Abbas r.a. se riwayat hai ke mujhse Hazrat Abi Ibn Ka’ab r.a. ne bayaan kiya ke Rasool Allah ﷺ ne farmaya : “Wo dono (Hazrat Musa a.s. aur Hazrat Khizar a.s.) chale hatta ke jab ek basti par aaye to unhone basti walon se khana talab kiya. Basti walon ne inki mehmaan nawaazi se inkaar kiya to unhone ek deewaar dekhi jo gira chahti thi.” Raawi-e-Hadees Sayeed Bin Jubair ne apne haath se is tarah ishara karke bataya ke Hazrat Khizar a.s. ne haath uthaya to deewaar khadi ho gayi. Ek dusre Raawi Hazrat Ya’ali Bin Muslim ke gumaan ke mutabiq Hazrat Sayeed Bin Jubair ne bataya ke unhone deewaar ko apne haath se chuwa to wo khadi ho gayi. (Hazrat Musa a.s. ne is par kaha : ) “Agar aap chahte to is kaam ki mazdoori le lete.” Raawi-e-Hadees Sayeed Bin Jubair kahte hain ke unki muraad ujrat thi ke hum us khaate (Istemaal me laate).

(8) BAAB : KISI KO DOPAHAR TAK MAZDOORI PAR RAKHNA

۞ Hazrat Ibn Umar r.a. se riwayat hai, wo Nabi ﷺ se bayaan karte hain ke Aap ne farmaya : “Tumhari misaal aur Ahl-e-Kitaab (Yahood-o-Nasara) ki misaal is shakhs ki tarah hai jisne chand mazdoor ujrat par lagaye aur kaha : wo kaun hai jo subah se dopahar tak ek qiraat par mera kaam kare ? to yahood ne yeh kaam kiya. Phir usne elaan kiya : tum me kaun ek qiraat par dopahar se le kar asar tak mera kaam karega ? to Nasara ne yeh kaam kiya. Phir usne kaha : Asar se le kar guroob-e-aftaab tak do (2) qiraat par kaun mera kaam karega ? to yeh kaam karne wale tum khud ho. Is par Yahood-o-Nasara barhum huye. Unhone kaha : yeh kya baat huyi kaam hum ne zyada kiya aur mazdoori thodi mili ? Us shakhs ne kaha : Kya tumhara haqq maine daba liya ? Unhone kaha : Nahi. Tab us shakhs ne kaha : Yeh mera fazal hai, Mai jise chahoon dun.”

(9) BAAB : ASAR KI NAMAAZ TAK KE LIYE MAZDOOR RAKHNA

۞ Hazrat Ibn-e-Umar r.a. se riwayat hai ke Rasool Allah ﷺ ne farmaya : “Tumhari misaal aur yahood-o-nasara ki misaal us shakhs ki tarah hai jisne mazdoori ke liye mazdoor lagaye aur kaha : kaun hai jo dopahar tak ek ek qiraat par mera kaam kare ? Yahood ne ek ek qiraat par kaam kiya. unke baad Nasara ne ek ek qiraat par kaam kiya. Phir tum log ho jo Namaz-e-Asar se guroob-e-aftaab tak do do (2-2) qiraat par kaam karte ho. Yahood-o-Nasara naraz huye aur kahne lage : Hamara kaam zyada hai lekin hame mazdoori bahut thodi mili. Irshad hua : kya maine tumhare haqq mein koi kotahi ki hai ? Unhone ne kaha : Aisa hargiz nahi. Farmaya : yeh mera fazal-o-ehsaan hai mai jise chahoon dun.”

(10) BAAB : US SHAKHS KA GUNAAH JO MAZDOOR KI UJRAT NA DE

۞ Hazrat Abu Hurairah r.a. se riwayat hai, wo Nabi ﷺ se bayaan karte hain ke Aap ne farmaya : “Allah Ta’ala ka irshad-e-giraami hai : Teen (3) shakhs aise hain ke qayamat ke din mai unke khilaaf madaai honga : Ek wo shakhs jisne mere naam ke waaste se kisi ke saath ahad-o-paimaan kiya, phir ahad shikni ka murtakib hua. Dusra woh shakhs jisne kisi azaad ko ghulaam bana kar beech dala aur uski qeemat harap kar gaya. Teesra wo jisne koi mazdoor rakha, us se kaam to pura liya lekin use uski mazdoori na di.”

(11) BAAB : ASAR SE RAAT TAK MAZDOOR LAGANA

۞ Hazrat Abu Musa Ash’ari r.a. se riwayat hai, wo Nabi ﷺ se bayaan karte hain ke Aap ne farmaya : “Musalmano, Yahood aur Nasara ki misaal us shakhs ki tarah hai jisne kuch logo ko kaam par lagaya ke wo din se raat tak kaam karen unhe tay shuda mazdoori di jayegi. Unhone aadha din uska kaam kiya phir bole ke jo mazdoori aapne thehrai thi wo hame nahi chahiye aur jo kuch humne kiya wo sab baatil aur zaya hai. Us shakhs ne unse kaha : Aisa na karo balke apna kaam pura karo aur apni mazdoori puri lo. Wo na maane aur kaam chhor kar chale gaye. Unke baad us shakhs ne dusre mazdoor rakhe aur unse kaha : Bakiyaah kaam baaki din mein pura karo aur tumhe wahi mazdoori milegi jo maine pahle logo se tay ki thi. Unhone kaam kiya. Jab asar ka waqt hua to unhone kaha ab tak humne jo kaam kiya hai wo baatil aur zaya thehra aur wo mazdoori jis par aapne hume kaam par lagaya tha use apne pass rakho. Us shakhs ne inse bhi kaha ke tum baaki din pura karlo kyun ke thoda sa din baaki rah gaya hai lekin unhone inkaar kar diya, chunanche baaqi din ke liye us shakhs ne kuch aur logo ko kaam par lagaya. Unhone baaki din kaam kiya hatta ke suraj guroob ho gaya. Is tarah inhone puri mazdoori pahle aur dusre mazdooron ki bhi paayi. Chunanche yeh misaal hai un (Yahood-o-Nasara) ki (Jinhone is noor ko chhor diya) aur misaal hai in (Musalmano) ki jinhone is noor ko qubool kiya hai.”

(12) BAAB : JISNE KISI KO KAAM PAR LAGAYA AUR WOH APNI MAZDOORI CHHOR KAR CHALA GAYA PHIR KAAM PAR LAGAANE WALE NE MAZDOOR KI UJRAT SE KAAROBAAR KARNA SHURU KAR DIYA AUR WO (UJRAT) NAF’AH KI WAJAH SE ZYADA HO GAYI, YA JISNE KISI DUSRE KE MAAL SE KAAROBAAR KIYA AUR WO KHOOB PHALA PHULA

۞ Hazrat Abdullah Ibn-e-Umar r.a. se riwayat hai, unhone kaha ke maine Rasool Allah ﷺ ko yeh farmate huye suna : “Tumse pahle zamaane mein teen (3) aadmi ek saath rawaana huye taake wo raat guzaarne ke liye ek pahaad ki gaar mein jaa dakhil hue. Jab sab gaar mein chale gaye to ek patthar pahaad se larhak kar aaya jisne gaar ka muh band kar diya. Ab un teeno ne kaha : Hume koi cheez is patthar se nijaat nahi dila sakti magar ek zariya hai ke apni apni nekiyon ko bayaan karke Allah se dua karen, Chunanche inme se ek ne kaha : Aye Allah ! mere waledain bahut budhe the, mein unse pahle kisi ko shaam ka doodh nahi pilata tha na aapne baal bacchon ko aur na hi laundi ghulamo hi ko. Ek din kisi cheez ki talaash mein mujhe itni der ho gayi ke jab mai unke paas aaya to woh so gaye the, chunanche maine shaam ka doodh dooha aur iska bartan apne haath mein utha liya aur yeh mujhe shakht na-gawaar tha ke unse pahle mai apne ahl-o-aayaal ya laundi ghulamo ko doodh pilau, lehaza mai piyaala haath mein liye unke bedaar hone ka intezaar karta raha. Jab subah huyi to dono ne bedaar ho kar shaam ka doodh piya. Aye Allah ! Agar maine yeh kaam sirf teri raza joi ke liye kiya tha to humko is musibat se nijaat de de, chunanche wo patthar thoda sa apni jagah se hat gaya lekin wo is gaar se nikal na sakte the.” Nabi ﷺ ne farmaya : “Dusre shakhs ne kaha : Aye Allah ! Mere chacha ki ek beti thi jo mujhe sabse mehboob thi. Maine is se bure kaam ki khwahish ki lekin wo raazi na huyi. Hua yun ke ek saal qahat pada to wo mere paas aayi. Maine usko ek sau bees (120) dinaar is shart par diye ke wo mujhe bura kaam karne de. Wo raazi ho gayi lekin jab mujhe is par qudrat haasil huyi to kahne lagi : Mai tujhe na-haqq mehar todne ki ijazat nahi deti. (Yeh sun kar) maine bhi is baat ko gunaah khayal kiya aur us se alag ho gaya, halake wo mujhe sabse zyada mehboob thi. Aur maine jo sona use diya tha wo bhi chhor diya. Aye Allah ! agar maine yeh kaam mahaz teri raza joi ke liye kiya tha to jis musibat me hum mubtala hain isko door karde, Chunanacha wo patthar thoda sa apni jagah se aur sadak gaya magar wo us gaar se nahi nikal sakte the.” Nabi ﷺ ne farmaya : “Ab teesre shakhs ne kaha : Aye Allah ! maine kuch logo ko mazdoori par lagaya tha aur unhe unki mazdoori bhi de di thi, lekin ek shakhs apni mazdoori liye begair chala gaya. Maine uski raqam ko kaam mein lagaya jisse bahut sa maal haasil hua, chunache ek muddat ke baad wo mazdoor aaya aur kahne laga : Aye Allah ke bande ! Mujhe meri mazdoori de. Maine us se kaha : Yahan jitne oonth, gaaye, bakriyan aur ghulaam tu dekh raha hai yeh sab teri mazdoori ke hain. Usne kaha : Aye Allah ke bande ! mujhse mazaaq na kar. Maine Kaha : (Aisi koi baat nahi) mai tere saath mazaaq nahi kar raha. Tab usne tamaam cheezen apne qabze me le liye aur unhe haank kar le gaya aur usme se kuch bhi na chhora. Aye Allah ! agar maine yeh kaam mahaz teri khushnudi ke liye kiya tha to yeh musibat humse taal de jisme hum mubtala hain, chunanche wo patthar bilkul hatt gaya aur woh us gaar se bahar nikal kar chale gaye.”

(13) BAAB : BAR BARDARI SE MAZDOORI KAMAANE, PHIR USE SADQA KARNE AUR BAR BARDARI KI UJRAT KA BAYAAN

۞ Hazrat Abu Masood Ansari r.a. se riwayat hai, unhone kaha ke Rasool Allah ﷺ jab sadqa-o-khairaat karne ka hukm dete to hum mein se koi shakhs bazaar jaata aur bar bardari karke (bojh utha kar) ek mad gallah haasil karta (aur use sadqa karta) jabke aaj unme se baaz lakhon mein khelte hain. Raawi-e-Hadees (Hazrat Shaqeeq) kahte hain ke mere khayal ke mutabiq Hazrat Abu Masood Ansari r.a. ne “Baaz” se muraad khud hi ko liya hai.

(14) BAAB : DALAAL KI UJRAT

Imaam Ibn-e-Sereen, Hazrat Ata’ah, Ibraheem Nakhai aur Hasan Basri r.a. kahte hain ke dalali ki ujrat mein koi qabahat nahi. Hazrat Ibn-e-Abbas r.a. kahte hain : Agar koi shakhs kisi se kah ke jaaye ke yeh kapda itne me farokht kardo aur us (Muqararah Qeemat) se zyada jo nafaa ho woh tumhara hai, Isme koi harz nahi. Ibn-e-Sereen rahma allah kahte hain ke isme bhi ko kharabi nahi ke agar koi dusre se kahta hai ke falaan cheez itne me farokht kardo jo nafaa ho wo tumhara ya mere aur tumhare darmiyan mushtark hai. Nabi ﷺ ka irshad-e-giraami hai : “Musalmaan apni sharait ke paband hain.”

۞ Hazrat Ibn-e-Abbas r.a. se riwayat hai, unhone kaha : Nabi ﷺ ne is amr se mana farmaya hai ke bazaar mein maal tijarat laane walon se aage badh kar maamla tay kiya jaaye. Aur farmaya ke koi shahri kisi dehaati ka maal na farokht kare. Raawi-e-Hadees kahte hain ke maine Hazrat Ibn-e-Abbas r.a. se daryaft kiya ke koi shahri kisi dehaati ka maal farokht na kare, iska kya matlab hai ? Unhone farmaya ke iska dalaal na bane.

(15) BAAB : KYA KOI SHAKHS DAAR-UL-HARAB MEIN KISI MUSHRIK KI MAZDOORI KAR SAKTA HAI ?

۞ Hazrat Khabab Bin Arat r.a. se riwayat hai, unhone farmaya : Mai lohaar ka pesha karta tha. Maine Aas Bin Wayel ka ek kaam kiya. uske paas meri mazdoori jamaa ho gayi. Maine usse apni ujrat ka mutalba kiya to usne kaha : Allah ki qasam ! main tumhe kodi na dunga taake  tu “Mohammad” ka inkaar kare. (Hazrat Khabab kahte hain) Maine kaha : Allah ki Qasam ! Mai aap ka inkaar nahi karunga hatta ke tu marr jaaye, phir zinda kiya jaaye. usne kaha : Kya mujhe marna bhi hai aur phir uthna bhi hai ? Maine kaha : Haan. Usne kaha : Phir to wahan mere pass maal bahut hoga aur aulaad bhi to (wahan) teri mazdoori ada kardunga. Tab Allah Ta’ala ne yeh Aayat naazil farmayi: “(Aye Nabi !) kya tumne us shakhs ko dekha jisne meri aayat ka inkaar kiya aur kaha ke mai maal aur aulaad diya jaunga.”

(16) BAAB : QABAIL-E-ARAB PAR FATIHA PADH KAR DAM KARNE KE EWAZ JO KUCH DIYA JAAYE USKA HUKM

Hazrat Ibn-e-Abbas r.a. Nabi Kareem ﷺ se bayaan karte hain ke “sabse zyada ujrat lene ke layak Allah ki kitaab hai.” Imaam Shaibi ne kaha : Mu’allim shart na kare (ke use kuch diya jaaye) albatta use jo kuch diya jaaye use qubool kar le. Hazrat Hakam kahte hain : Maine kisi se nahi suna ke usne Mu’allim ki ujrat ko Makrooh khayal kiya ho. Hazrat Hasan Basri ne das (10) dirham ba-taur ujrat ada kiye. Ibn-e-Sereen ne taqseem karne wale ki ujrat mein koi qabahat nahi samjhi. Unhone kaha ke faisle mein riswat lene ko sahat kaha jaata hai jabke Kharas, yaani andaza lagane wale logon ko ujrat di jaati thi.

۞ Hazrat Abu Saeed Khudri r.a. se riwayat hai, unhone farmaya ke Nabi ﷺ ke kuch sahaba kisi safar par rawana huye. jaate jaate unhone Arab ke ek qabile ke paas padaao kiya aur chaha ke Ahl-e-Qabila unki mehmani karen magar unhone is se saaf inkaar kar diya. Isi dauraan mein us qabile ke sardar ko kisi zahreeli cheez ne dans liya. Un logo ne har qism ka elaaj kiya magar koi tadbeer kargar na huyi. Kisi ne kaha : Tum un logon ko pass jaao jo yahan padaao kiye huye hain, Shayad unme se kisi ke pass koi elaaj ho, Chunanche wo log Sahaba-e-Kiraam r.a. ke pass aaye aur kahne lage : Aye logo ! hamare sardar ko kisi zehreeli cheez ne dans liya hai aur humne har qism ki tadbeer ki hai magar kuch faida nahi hua, kya tum me se kisi ke pass koi cheez (elaaj) hai ? Unme se ek ne kaha : Allah ki qasam ! Mai jhaad phoonk karta hun, lekin wallah ! tum logon se humne apni mehmani ki khwahish ki thi to tumne isse mustard kar diya tha, ab main bhi tumhare liye jhaad phoonk nahi karunga jab tak tum hamare liye koi ujrat muqarrar nahi karoge. Aakhir unhone chand bakriyon ki ujrat par inko raazi kar liya, chunanche (sahaba mein se) ek aadmi gaya aur Surah-e-Fatiha padh kar dam karne laga to woh shakhs (aisa sehatyaab hua) goya iske band khol diye gaye hon, phir woh uth kar chalne phirne laga. aisa maloom hota tha ke ise koi bimaari thi hi nahi. Raawi kahte hain : Un logon ne inki muqarrah ujrat inke hawaale kardi to Sahaba-e-Kiraam aapas mein kahne lage : Ise taqseem kar lo lekin dam karne wale ne kaha : Abhi taqseem na karo tawaqtekah hum Nabi ﷺ ki khidmat mein pahunch kar us waqiye ka tazkirah karen aur maloom karen ke Aap ﷺ iske mutalliq kya hukm dete hain, chunanche wo Rasool Allah ﷺ ki khidmat me haazir huye aur Aap se ye waqiya arz kiya to Aap ne farmaya : “Tumhe kaise maloom hua ke (Surah-e-Fatiha) se jhaad phoonk ki jaati hai ?” Phir farmaya : “Tumne theek kiya. Inhe taqseem karlo, balke apne saath mera hissa bhi rakho.” Yeh keh kar Nabi ﷺ muskura diye.

Abu Abdullah (Imaam Bukhari rahma allah) kahte hain : Hazrat Shauba ne kaha ke hum se Abu Bashar ne bayaan kiya, unhone kaha : Maine Abul Matawakkul se yeh Hadess suni hai.

(17) BAAB : GHULAAM PAR TAX AAYED KARNA AUR LAUNDIYON KE ZIMME WAJIBAAT KI NIGRANI KARNA

۞ Hazrat Anas r.a. se riwayat hai, unhone kaha ke Abu Taybah ne Nabi ﷺ ko poochne lagaye to Aapne iske liye ek ya do sa’ah anaaj dene ka hukm diya aur us ke maalkaan se sifarish ki ke jo tax is par muqarar hai, usme kuch kami kar den (to wo kam kar diya gaya).

(19) BAAB : GHULAAM KE MAALKAAN SE ISKA YAUMIYA TAX KAM KARNE KI SIFARISH KARNA

۞ Hazrat Anas r.a. se riwayat hai, unhone kaha ke Nabi ﷺ ne seengi lagane wale ghulaam ko bulaya to usne aap ko poochne lagaye aur Aap ne uske liye ek (1) sa’ah ya do (2) sa’ah ya ek ya do (1 ya 2)  mad gallah dene ka hukm diya aur us ke maamle ke mutalliq guftugu farmayi to iska muqarrarah yaumiya tax mein kami kardi gayi.

(20) BAAB : FAHISHA AURATON AUR LAUNDIYON KI KAMAYI

Hazrat Ibraheem Nakhai ne been karne wali aur gulukaara ki ujrat ko makrooh qaraar diya hai. Aur Irshad-e-Baari Ta’ala : “Aur apni laundiyo ko badkaari par majboor na karo jabki wo ufat aur paak daamni chahti hain, mahaj is liye ke kuch matah duniya tumhe haasil ho jaaye aur jo unhe majboor karega to yaqeenan is majboori ke baad Allah be-hadd bakhsne wala nihayat meharban hai.”

Hazrat Mujahid kahte hain : (فتیاتکم) se muraad tumhari laundiyan hain.

۞ Hazrat Abu Masood Ansari r.a. se riwayat hai ke Rasool Allah ﷺ ne kutte ki qeemat, zaaniya ki kamayi aur kahin ki shereni se mana farmaya hai.

۞ Hazrat Ibn-e-Umar r.a. se riwayat hai, unhone kaha : Nabi ﷺ ne jufti karwane ka mo’aafza lene se mana farmaya hai.

(22) BAAB : JAB KOI ZAMEEN THIKE PAR LE AUR MAAMLE KA EK FAREEQ MAR JAAYE

Ibn-e-Sereen rahma allah kahte hain ke matufi ke wirsa ke liye jayez nahi ke wo muddat puri hone se pahle thike daar ko be-dakhal kare. Hazrat Hakam, Imaam Hasan Basri aur Ayaas bin Muawiya rahma allah ne kaha hai ke muddat khatm hone tak ujarah baaqi rakha jaayega. Hazrat Ibn-e-Umar r.a. ne farmaya ke Nabi ﷺ ne khaibar ki zameen batayi par di. Phir yahi ujarah Nabi ﷺ ke ahad, Hazrat Abu Bakr r.a. ke zamane tak balke Hazrat Umar r.a. ki khilafat ke ibtedayi aaiyaam tak jaari raha. Aur yeh zikr kahi nahi hai ke Hazrat Abu Bakr r.a. (aur Hazrat Umar r.a.) ne Nabi ﷺ ki wafaat ke baad us ujarah ki tajdeed ki ho.

۞ Hazrat Ibn-e-Umar r.a. se riwayat hai ke Rasool Allah ﷺ ne khaibar ki zameen yahoodiyon ko is shart par di ke wo isme mehnat karen aur kaashat karen aur paidawaar ka nisf hissa unhe milega. Hazrat Ibn-e-Umar r.a. ne bayaan kiya ke zarayi araazi ka ek kiraya thehra kar kaashat ke liye di jaati thi (Raawi kahta hai ke) kiraye ka ta’iyyan Hazrat Naafey ne bayaan kiya tha lekin mujhe yaad nahi raha.

۞ Hazrat Raafey Bin Khadeej r.a. bayaan karte hain ke Nabi ﷺ  ne zarayi araazi ko kiraye par dene se mana farmaya hai.
Hazrat Obaidullah ne is riwayat ko Hazrat Naafey se, unhone ne Ibn-e-Umar r.a. se bayaan kiya hai. Isme itna izafa hai : taake Hazrat Umar r.a. ne yahoodiyon ko jila watan kar diya.
